This Agreement("Agreement") is entered into by and between Erase The Case, PLLC("Attorney") and the undersigned client ("Client") and becomes binding upon payment for services on start.erasethecase.com.
Attorney’s intention is to provide quality record expungement/sealing legal representation through experienced legal counsel and staff, and to expunge/seal Client’s case(s) expeditiously andstrategically. As part of this process, all eligibility tests completed onlinewill be reviewed for accuracy by Attorney. If, after review, Attorneydetermines that Client is not eligible under Florida law, a full refund will beissued under our Money-Back Guarantee. Once representation is accepted,Attorney will personally call Client to discuss the legal strategy, goals, anddesired outcome — whether it be employment, licensing, school admission, orreputation management — because expungement is often a means to a greater end.
1. SCOPE OF SERVICES BY TIER Upon successful payment, Attorney agrees to provide legal services to Client in accordance with the service tier selected at checkout:
Mugshot removals are pursued via written legal demand and negotiation, and results are not guaranteed. This tier also includes: •Expanded Background Check Removal (see Appendix “A”) • Comprehensive MugshotTakedown Support • Dedicated Case Monitoring • 100% Money-Back Guarantee (seeSection 8).
Florida Record Expungement or Sealing services may include one or multiple eligible criminal cases or arrests unless determined to be 'extraordinary cases' at Attorney's sole discretion. In such an event, thefee may be modified to reflect Tier 2 or Tier 3 pricing based on case complexity. If Client does not accept the modified fee, a 100% refund will be issued.
Attorney will conduct a case review, prepare and file all required legal documents, and where applicable, appear in court for the petition hearing so that Client does not need to appear.
All tiers include problem-solving of non-extraordinary issues (as determined by Attorney) involving the Clerk of Courts, StateAttorney’s Office, FDLE, or the Court, as these are customary and expected in the expungement process.
All mugshot removals must first be confirmed byAttorney as removable. Any mugshot that is determined to be incapable of removal due to the website’s refusal to cooperate will result in a $250 refund per such mugshot.
Services do not include appearances at contested hearings, including when an interested party files an objection or opposition.Such extraordinary matters may require additional legal fees and a separate written agreement.
If more than twelve (12) months pass from the date of payment and Client has not submitted a fully completed RecordExpungement Packet (prepared by Attorney’s legal team upon engagement),Attorney reserves the right to assess additional fees prior to continuing representation.
2. CONDITIONS TO BEGIN WORK Attorney shall not begin services until all fees are paid in full. Attorney will confirm representation by issuing an engagement letter. Client must also cooperate fully and provide all necessary documentation and information.
3. EARNED UPON RECEIPT / NON-REFUNDABLE POLICY All legal fees are considered Earned Upon Receipt (EUR) and will be deposited into Attorney’s operating account.These fees are non-refundable except as specifically provided under the Money-Back Guarantee in Section 8.
4. AUTHORIZATION TO REPRESENT Client grants Attorney full authority to represent, file, appear, and sign documents on Client’s behalf in the matter of record expungement/sealing and associated services.

6. EXTRAORDINARY CIRCUMSTANCES If a case involves unforeseen or extraordinary legal work (e.g., contested hearings, motions to compel, writs, or appeals), Attorney may require additional fees and a separate written agreement.
7. VENUE AND LIMITATION OF LIABILITY All legal disputes shall be adjudicated in theEleventh Judicial Circuit, Miami-Dade County, Florida. Liability is limited to the amount paid for services. Attorney shall not be liable for delays caused by courts, agencies, or third parties.
8. MONEY-BACK GUARANTEE (LIMITED) Client is entitled to a full refund of all fees paid under this Agreement only under the following circumstances:
(a) After reviewing the Client’s eligibility test responses and all supporting documentation, the Attorney determines that the Client is not eligible for record sealing or expungement under Florida law.
(b) The court denies the petition to seal or expunge the Client’s record with prejudice, and such denial is not the result of any misrepresentation, failure to disclose, or other act or omission by the Client.
(c) If the Client provided inaccurate or incomplete information in the online eligibility test at https://erasethecase.com, via electronic means or via a telephone consultation, and the Attorney’s review or work subsequently reveals ineligibility, a non-refundable administrative fee of $500.00 will be deducted from the total retainer. The remaining balance will be refunded to the Client.
No refunds will be issued under any other circumstances.
9. ENTIRE AGREEMENT AND MODIFICATIONS This document contains the full agreement. Any modification must be in writing, signed by both parties. Services not listed in this agreement are not included.
10. ACCEPTANCE By completing payment, Client confirms that they have read, understood, and agreed to all terms and conditions stated herein.This Agreement is effective immediately upon payment.
Appendix: Tier 3 Background Check Removal Index The following websites are targeted for removal under Tier 3 Background Check Removal Service. Attorney does not guarantee removal from every listed site, but will pursue takedown in good faith where legally permissible and technically feasible.

PRIVACY STATEMENT All information provided by Client during the qualification, intake, and representation process is protected pursuant toFlorida law and the Florida Rules of Professional Conduct governing attorney-client and prospective client confidentiality. Any data or documentation submitted is considered privileged and confidential, and will be used solely for the purpose of providing legal services by Erase The Case,PLLC.
